  1. Purpose of the Contract

These General Rental Terms & Conditions define the terms under which Sawadeebike Co., Ltd. (hereinafter referred to as “the Lessor”) rents out electric bikes and related accessories to its clients (hereinafter referred to as “the Lessee”).

 

  1. Rental Conditions
  • Age & Ability: The Lessee must be at least 16 years old and physically fit to ride a bike, with no medical restrictions.
  • Use of Equipment: The rented bike and accessories are for personal use only and cannot be lent or sublet to third parties. The Lessee agrees to handle the equipment responsibly and to respect the traffic laws in force in Thailand.

 

2.1 Contract termination in case of misuse

 

The rental agreement may be terminated immediately without refund in the following cases:

  • Alcohol & drugs: Riding under the influence of alcohol, drugs, or any narcotic substances (including cannabis) is strictly prohibited in Thailand and will result in immediate contract termination.
  • Improper use of the e-bike: Performing tricks, wheelies, skids, riding in hazardous or off-road conditions, etc. (non-exhaustive list).
  • Overloading the bike:
  • Vintage Brown: max. 2 adult riders
  • Buddy Bike: max. 1 adult + 1 child (lightweight, with adapted seat)

Exceeding these limits will result in contract termination without refund.

 

  1. Rental Duration
  • Rental duration is defined at the time of booking.
  • Any extension must be requested and approved at least 24 hours before the scheduled return.
  • Late returns may result in additional charges.
  1. Pricing & Payment
  • Rental rates are shown on our website and vary depending on the duration, bike model, and any accessories included.
  • Payment is made online or in-store, via the secure Stripe platform.
  1. Security Deposit
  • A security deposit is required at the time of booking.
  • It will be refunded upon return, subject to deduction for any repair or replacement costs due to damage or loss.
  1. Lessee Responsibilities

 

The Lessee is responsible for the routine care of the bike and accessories:

  • Battery charging
  • Tire pressure
  • Cleanliness of the bike and accessories

 

In case of damage, loss or theft, the Lessee must immediately notify the Lessor and may be held liable for any associated costs.

 

  1. Breakdown Assistance
  • In case of a mechanical breakdown not due to misuse (see section 2.1), the Lessor will intervene and attempt to repair on-site.
  • If repair is not possible, a replacement bike of the same category will be provided.
  • If no replacement is available, the rental will be fully refunded.
  • If the issue is due to misuse by the Lessee, repair and call-out costs will be charged.

 

7.1 Flat Tire

 

  • In case of a flat tire, the Lessee must first use the puncture repair kit provided.
  • If the kit fails, the Lessor will provide free on-site assistance. The tire itself will be invoiced.
  1. Insurance
  • The Lessee is advised to check their own insurance coverage regarding the use of rented bicycles in Thailand.
  • The Lessor offers an optional insurance covering certain risks (please refer to the Sawadeebike insurance contract for details).
  1. Return of Equipment
  • All rented equipment must be returned on the agreed date and time, in the same condition as upon pickup.
  • The battery must be at least 90% charged upon return.
  • Any late or damaged returns may result in additional fees.
  1. Cancellations & Refunds
  • Cancellation by the Lessee: Full refund if cancelled at least 72 hours before rental start. After this deadline, 50% cancellation fee will apply.
  • Cancellation by the Lessor: In case of cancellation due to exceptional circumstances, the Lessee will receive a full refund.
  1. Disputes

 

In case of a dispute, both parties agree to seek an amicable solution. Failing that, the matter will be referred to the competent Tourist Police authorities.
